Express Entry Program

It is the flagship program of Canadian immigration based on points awarded to applicants for their credentials and skills. It manages the profiles of candidates who have applied under federal skilled immigration programs – Federal Skilled Worker Program, Federal Skilled Trades Program, and Canadian Experience Class (CEC).

A lawyer is a skilled profession and candidates have to apply under the Federal Skilled Worker Program (FSWP). Can now apply for PTFE, applicants must meet the following minimum requirements based on the points awarded to the applicant so that they can meet the 67 point eligibility program:

  • Age
  • Education
  • Work Experience
  • Valid Job offer from the country
  • Language Proficiency
  • Adaptability

What are the eligibility criteria to apply under FSWP?

Applicants must meet the following requirement to apply under the Federal Skilled Worker Program (FSWP):

  • Must have acquired one year’s work experience of continuous full-time work for paid employment within the past 10 years, classified under NOC skill level type 0, A, or B.
  • Applicants must achieve a minimum Canadian Language Benchmark (CLB) score of 7.
  • Must have a minimum degree, certificate, or diploma for a post-secondary school that is assessed by the Educational Credential Assessment (ECA).
  • Immigrants must show proof of funds to prove that they have enough money for themselves and family members for moving to Canada unless they have a valid job offer from an eligible employer of the country.

Provincial Nomination Program (PNP):

Each province/territory in Canada through the Provincial Nomination Program can nominate highly skilled and competent immigrants for permanent residence in their province. Every PNP has a different requirement that depends on the demands of the local labour market.

Each provincial nomination program also has different streams that help immigrants apply their skills and abilities. Indian lawyers can apply under PNP in-demand professional categories. Each province has occupations that are in demand in its local labor market and they list them in a list that is updated regularly. Complying with the In-Demand Professions Stream requirements for that particular province may obtain the applicant’s permanent residence in that province.

To become a lawyer in Canada, the candidate must be qualified to be admitted to the Law Society of any of the provinces. For this candidate needs to follow three steps:

  • NCA Law Degree Equivalency Certificate (which ranges from 3 months to 5 years maximum)

OR

LLM degree from a Canadian university, covering NCA requirements

  • Articling (it depends on how quickly applicants can get an internship, from there it requires a minimum of one year)

OR

Complete an 8-month legal practice program from a recognized Canadian university.

  • Bar exam which is a demonic 6-hour open book exam

>Indian lawyers must have their degree assessed by the Federal Law of Society (FLSC) by creating their profile on the National Accreditation Committee (NCA). The same applicants must pay the required fee of CAD 410 and request the university from which the applicant graduated to send the transcripts to the FLSC. NCA can take approximately 10 exams per challenge before applying for a Certificate of Qualification (COQ). Once the candidate can take the NCA challenge exam or the LLM program, they can apply for the Certificate of Qualification (COQ) and register with the bar of their choice. Registration with a bar is compulsory before the candidate can apply for the internship position. The law firm must also be authorized by the bar to offer an internship position. It is mandated by the bar which requires that a standard agreement be ratified between the cabinet and the article for it to be a valid article.

Once candidates have completed the term, candidates must submit their certificate of experience to the Bar and can register for the Bar exam which takes place three times a year.
